The Victim Offender Reconciliation Program of New York (VORP) is a non-profit organization dedicated to providing the courts of New York with an alternative to incarceration. Bail is an alternative to incarceration. Bail is also the constitutional support for the presumption of innocence. Bail is the accused persons' opportunity to obtain and work with legal counsel for his/her defense.
VORP of New York,Inc., operates a school for bail agents. The purpose of the school is to provide bail bond agent with trained bail agents to supervise the conduct of defendants released to bail bondspersons pending the adjudication of their case. We believe ever occupation must train personnel needed to properly service its' business. Currently bail agents in New York City are subject to unnecessary governmental hardship which reduces their ability to properly supervise defendants.
In the interests of public safety the New York State legislature enacted several laws to protect the public from defendants accused of a crime and released on bail. It is the intention of the State of New York to protect its' citizens from bailed defendants by enacting laws that give bail agents the same power of arrest given the New York police regardless of local laws to the contrary. These laws may be misinterpreted by the police and the courts to the detriment of bail bond and bail enforcement agents.
Why should the New York citizen care when governmental agents violate the rights of bail agents? The Eighth Amendment to the U.S.Constitution guarantees every citizen the right to a fair trial and bail upon accusation of a crime. To date there is no national organization dedicated to a fair bail system. After 9/11 you may be accused of a crime and denied bail subject to the accusation. The presumption of innocence has been abolished and the right to bail has been amended. Anyone can be arrested and held without bail.
Every person has a double or look a like that can cause you to be arrested. If you cannot prove where you were when a crime was committed by a person who looks like you, you will lose your freedom. If you cannot afford an attorney one will be appointed for you, but will that appointed attorney work as hard as possible to secure your freedom?
